Article 1 – NRTO
The LOI is a member of the Dutch Council for Training and Education (NRTO). These General Terms and Conditions are in line with the General Terms and Conditions for Consumers and the NRTO code of conduct.
Article 2 – Offer
The LOI offer contains a complete and accurate description of the Training and/or the Training Material that is part of the Training.
In any case, the offer states the following information in a clear and understandable manner:
when the Training starts;
the admission requirements to participate in the Course;
the Price including all additional costs and taxes;
the method of payment;
the Study and Service Duration.
These General Terms and Conditions are expressly announced to the Customer prior to the conclusion of the Agreement between the Customer and the LOI and form an integral part of the general information provision of the LOI. The General Terms and Conditions apply in full to all agreements that the LOI concludes with the Customer.
Without prejudice to the provisions of paragraphs 1 to 3, the offer for a Distance Agreement also includes the following information:
the identity and address of the LOI, including the visiting address;
the Customer's right to terminate the Study Agreement within 14 calendar days in accordance with Article 8.
Article 3 – Establishment of Study Agreement
By registering for a Course, the Customer enters into a Study Agreement with the LOI for the agreed Service Duration and the Customer agrees to the General Terms and Conditions as stated here.
Registration for a Course takes place (i) via a physical registration form, (ii) by telephone or (iii) via the web form on the Website.
The Study Agreement is concluded as soon as acceptance of the offer by the Customer has reached the LOI and the LOI has confirmed receipt thereof. Confirmation will take place immediately after registration by e-mail.
For HBO courses, the Study Agreement, together with these General Terms and Conditions, serves as the first part of the Education Agreement (OOK). The second part of the education agreement (about the study planning) is concluded with the coach at the beginning and during the study.
Meeting any admission requirements for a Course is not a condition for the conclusion of the Study Agreement. The Study Agreement will be concluded even if the admission requirements are not met.
The Customer is not entitled to transfer the rights and obligations under the Study Agreement to a third party without written permission from the LOI. The Customer is also not entitled to allow a person other than that stated on the registration form to participate in an Open Line Training without written permission from the LOI. The LOI may attach further conditions to this permission.
Article 4 – Additional information
When registering for a legally recognized (MBO, HBO) Course, the Customer undertakes to provide a number of legally required additional information. The Customer provides the following information within 30 days:
Copy of the diploma(s) approved by the LOI;
Personal number (PGN), this can be a BSN number or education number; and
A (signed) education agreement. After receipt of the information referred to under points a) and b), the education agreement will be sent to the Customer. In the case of an MBO Course, this must be signed and received by the LOI within 30 days of the registration date.
If the information referred to above in paragraph 1 is not provided in a timely and/or complete manner or does not meet the requirements applicable to the relevant Course, the Student cannot (further) study or participate in exams at any time.
Article 5 – Price
The costs of the Training, the payment method, any number of payment terms, registration fee, examination fee and other possible additional costs are stated in the Training Information.
For companies and institutions, LOI Zakelijk B.V. a specific training proposal can be made for an In-company/customized training. This offer replaces the price information as stated in the Course Information on the website and/or study guide.
All amounts stated in the LOI are exclusive of VAT. A legally recognized training course is exempt from VAT and will be provided by Leidse Onderwijsleidingen B.V.
A non-legally recognized Course is in principle charged with the applicable VAT rate and will be provided by LOI Zakelijk B.V.
Article 6 – Payment
The LOI is entitled to be informed by third parties about the creditworthiness of a Customer who has registered for the Training. This may affect the payment terms offered.
Payment of the Price must be made no later than the due date stated on the relevant invoice. The LOI has a payment term of 14 days.
The Customer is legally in default without additional notice of default being necessary from the date on which the applicable payment term has expired and the invoice amount due has not been paid in full. The LOI will then send the Customer a payment reminder, after which the Customer can still pay within the period stated therein. If the Customer has not paid the invoice amount due after this period, the LOI may charge the Customer statutory (commercial) interest with effect from the date on which the original payment period has expired.
Any extrajudicial or judicial collection costs will be borne by the Customer. With regard to the amount of the (extra)judicial collection costs, compliance will be sought with the applicable legal regulations.
Private Customers remain responsible at all times for obligations arising from the agreement with the LOI. Even if the payment has been or will be transferred to a third party, such as an employer.
Article 7 – Right of withdrawal
If the Customer is a private individual, the agreement may be revoked free of charge and without giving reasons within 14 calendar days after it has been concluded.
The Customer exercises the right of withdrawal by completing the withdrawal form within this period and sending it to LOI. The form is available at www.loi.nl/herroepingsrecht.
After receipt of the request for revocation by the LOI, the Customer still has 14 days to return any received items, including Training Material, with sufficient postage. The LOI will refund any tuition fees paid as soon as possible.
Returns are only accepted if the items are in their original condition. This means undamaged and unwritten, complete, only handled as reasonably necessary for viewing and in the original packaging. If these conditions are not met, the LOI will not accept the return shipment and the Customer is obliged to compensate a depreciation to be determined by the LOI.
Article 8 - Studying from abroad
Customers abroad pay a surcharge per month to cover additional costs for shipping, among other things. Contact days, meetings and exams are organized exclusively in the Netherlands. Customers who wish to attend these should take this into account. More information about places and dates can be found on LOI Campus.
